Terms of Service

1. Acceptance of Terms
   By accessing or using MakeMyPatch ("Service"), you agree to be bound by these Terms of Service.
2. About the Service
   MakeMyPatch is a software-as-a-service platform operated by MakerMuse that provides AI-assisted patch design generation and design evaluation tools.
3. Accounts
   Users must maintain the security of their accounts. Account sharing is not permitted. MakerMuse may suspend or terminate accounts for abuse, misuse, non-payment, or violation of these Terms.
4. Plans, Credits, and Pricing
   The Service offers Free and Creator plans. Credits are used for design generations and checks and expire as specified. Pricing may change at any time.
5. Payments and Refunds
   Payments are one-time in CAD. Refunds are available only if no credits have been used and must be requested within 3 months. Credits will be removed upon refund. Users are encouraged to contact support before initiating a chargeback. Accounts may be suspended in cases of chargebacks.
6. Acceptable Use
   Users agree not to engage in illegal activity, system abuse, reverse engineering, or reselling access.
7. Intellectual Property
   MakerMuse owns the Service. Users own generated designs but are responsible for ensuring they do not infringe third-party rights.
8. AI Disclaimer
   The Service uses AI. Outputs may not be accurate or suitable for manufacturing. Users must independently verify designs.
9. Non-Affiliation
   The Service is not affiliated with any military or government organization.
10. No Guarantees
    The Service is provided for design assistance only. No guarantees are made regarding manufacturability or outcomes.
11. Limitation of Liability
    To the maximum extent permitted by law, MakerMuse’s liability is limited to the amount paid by the user in the 12 months preceding the claim. MakerMuse is not liable for indirect, incidental, or consequential damages.
12. Indemnification
    Users agree to indemnify and hold harmless MakerMuse from any claims, damages, losses, or expenses arising from their use of the Service, including any content they create or use.
13. Fair Usage and Misuse
    Users must use the Service reasonably. MakerMuse may limit, suspend, or revoke credits for misuse, excessive use, or attempts to exploit the system.
14. Anti-Automation
    Users may not use bots, scripts, or automated means to access or use the Service.
15. Dispute Resolution
    Users agree to first attempt to resolve disputes informally by contacting support. If unresolved, disputes shall be resolved through binding arbitration in Alberta, Canada, except where prohibited by law. Claims must be brought within one (1) year.
16. Changes to Service and Terms
    MakerMuse may modify the Service or these Terms at any time. Continued use constitutes acceptance.
17. Privacy
    Use of the Service is subject to the Privacy Policy.
18. Governing Law
    These Terms are governed by the laws of Alberta, Canada.
